Bayleys Agency Agreement

If the exclusive representation contract applies to a residential property and for a period of more than 90 days, you or the seller may terminate the contract at any time after 90 days. You may be contacted by a service provider who wants to sign an agency contract with you, even though they have an existing single representation contract with another agency. We advise you not to accept this supplier as a customer until their contract ends. Bayleys, without your knowledge or consent, will not make repairs above the limit set out in our agreement on your property (unless the repair is defined as “urgent” in accordance with the Tailings Act). You should also warn them that if you terminate the agency contract with you and then sell it privately to someone you introduce, they may still be required to pay a commission. In order to reduce disputes over the termination of agency contracts and the payment of commissions, the Real Estate Agents Authority (REAA) and the Real Estate Institute of NZ have developed certain standard clauses for agency contracts. The use of clauses by an agency is voluntary, but sellers are encouraged to only sign agreements with agencies that use these clauses. You must declare that your agency has an internal complaints procedure for handling complaints and that the supplier can file a complaint with REA without first using your internal complaint procedure.
